Software License Agreement

End User License Agreement (EULA)

Please read this End User License Agreement carefully before accessing or using the SharkFilet software suite, including our web applications, Creator OS broadcasting tools, OBS browser source overlays, ARK Smart Mirror 3D visualization shaders, and NFC NTAG424 cryptographic verification protocols.

SharkCare Covenant & Operating Principle

“Universal Healthcare is our goal, not a guarantee. We aim to be able to help more and more people if and only if the Commerce volume supports the operations of paying users' bills.”

All platform healthcare assistance and direct bill subsidies are funded solely from the 10% platform commerce allocation on settled transactions. Participation or software access does not constitute an insurance policy, statutory entitlement, or unilateral debt obligation of SharkFilet LLC.

1. Grant of License

Subject to your ongoing compliance with this Agreement and our Terms & Conditions, SharkFilet LLC grants you a personal, non-exclusive, non-transferable, revocable, limited license to access and use the Platform services, including:

  • Creator Tools & OBS Overlays: The right to embed SharkFilet Browser Sources into your broadcasting software (OBS Studio, Streamlabs, vMix) solely for legitimate live stream commerce, alert generation, and drop promotions.
  • ARK Smart Mirror 3D Engine: The right to utilize client-side WebGL/WebGPU spatial sizing and AR visualization tools for garment fit inspection.
  • NFC Digital Twin Verification: The right to interact with and authenticate physical garments using our cryptographic NTAG424 provenance verification protocol.

2. License Restrictions

You agree that you will not, directly or indirectly:

  • Reverse engineer, decompile, disassemble, or derive the source code of the ARK Smart Mirror 3D fit engine, the double-entry $FILET ledger, or proprietary NFC validation algorithms.
  • Deploy automated bots, scrapers, or exploits to siphon drops, manipulate ledger balances, or falsify referral and sales metrics.
  • Circumvent or tamper with digital security mechanisms, including Stripe payment authentication or NFC cryptographic SUN validation hashes.
  • Sub-license, rent, lease, or resell access to Creator OS or proprietary software without express written authorization from SharkFilet LLC.

3. Payment Rails & Currency Standardization

All financial transactions, garment purchases, creator drops, and tip disbursements on SharkFilet are processed and settled exclusively in pure USD fiat currency through Stripe, Inc. SharkFilet does not custody or hold customer payment card data. The internal $FILET rewards program operates strictly as an in-house loyalty rewards ledger (5% cashback/points) with no external exchange liquidity or cash surrender value.

4. Advertising & Commercial Disclosures

Creators and streamers broadcasting commercial drops or sponsored merchandise using SharkFilet software must strictly adhere to FTC guidelines (16 CFR § 255). Users must include clear, conspicuous disclosure tags (e.g. "[SPONSORED]" or "#ad") on all promotional streams and shoppable clips.

5. Intellectual Property & User Content

SharkFilet LLC and its licensors retain all right, title, and interest in and to the Platform software, logos, trademarks, and Star Keep: The Ark universe lore. Designers and creators retain ownership of their respective original graphics and audiovisual assets, granting SharkFilet a limited license to manufacture, display, and fulfill selected drops.

6. Warranty Disclaimer & Limitation of Liability

THE SOFTWARE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND. SHARKFILET LLC DISCLAIMS ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. IN NO EVENT SHALL SHARKFILET LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE PLATFORM.

7. Governing Law & Dispute Resolution

This Agreement is governed by the laws of the State of Texas, without regard to conflict of law principles. Any dispute arising under or relating to this Agreement shall be resolved through confidential, binding arbitration in Jim Hogg County, Texas, or via remote digital proceedings administered by the American Arbitration Association (AAA).
